Terms of Service

1. Agreement to Terms

These Terms of Service ("Terms") govern your access to and use of the VIKTORIA MUSE platform and services (the "Service") operated by VIKTORIA MUSE ("we," "us," or "our").

By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

2. Service Description

VIKTORIA MUSE is an AI-powered marketing content platform that enables users to generate on-brand social media posts, email copy, ad creatives, blog content, and other marketing materials. The Service uses third-party AI models to generate content based on your brand settings and prompts.

3. Account Terms

  • You must be at least 16 years old to create an account and use the Service.
  • You must provide accurate and complete registration information and keep it up to date.
  • You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account.
  • You must notify us immediately at support@viktoriamuse.com if you suspect unauthorized access to your account.
  • One person or legal entity may maintain no more than one free account.

4. Acceptable Use

You agree not to use the Service to:

  • Generate content that is unlawful, defamatory, harassing, threatening, or promotes violence or discrimination.
  • Create deceptive, misleading, or fraudulent marketing materials.
  • Impersonate another person, brand, or organization without authorization.
  • Distribute spam, phishing messages, or unsolicited bulk communications.
  • Attempt to reverse-engineer, decompile, or extract the underlying AI models or algorithms.
  • Circumvent usage limits, rate limits, or access controls.
  • Upload malicious code, viruses, or any content designed to disrupt the Service.
  • Resell, sublicense, or redistribute generated content as part of a competing AI content generation service.

We reserve the right to suspend or terminate accounts that violate these terms at our sole discretion.

5. Intellectual Property

5.1 Your Content

You retain all rights to the content you create using the Service. Content generated through the platform based on your prompts and brand data belongs to you. You grant us a limited, non-exclusive license to store and process your content solely to provide and improve the Service.

5.2 Our Intellectual Property

The Service, including its design, features, code, documentation, and branding, is owned by VIKTORIA MUSE and protected by intellectual property laws. These Terms do not grant you any right to use our trademarks, logos, or brand elements without prior written consent.

5.3 Feedback

If you provide feedback, suggestions, or ideas about the Service, we may use them without restriction or obligation to you.

6. Payment Terms

  • Subscriptions — paid plans are billed on a recurring monthly or annual basis through Lemon Squeezy. Your subscription renews automatically unless cancelled before the end of the current billing period.
  • Free tier — we may offer a free tier with limited features and usage. Free tier availability and limits may change at any time.
  • Price changes— we may change subscription prices with at least 30 days' notice. Price changes take effect at the start of your next billing period.
  • Refunds — if you are unsatisfied with the Service, you may request a refund within 14 days of your initial purchase or renewal. Refund requests should be sent to support@viktoriamuse.com.
  • Cancellation — you may cancel your subscription at any time through your account settings or by contacting support. Cancellation takes effect at the end of the current billing period; no partial refunds are issued for unused time.

7. AI-Generated Content Disclaimer

Content generated by the Service is produced by artificial intelligence models and is provided on an "as-is" basis. You acknowledge and agree that:

  • AI-generated content may contain inaccuracies, errors, or unintended outputs. You are responsible for reviewing and editing all content before publishing or distributing it.
  • We do not guarantee that generated content will be original, non-infringing, or suitable for any particular purpose.
  • You are solely responsible for ensuring that content you publish complies with applicable laws, regulations, advertising standards, and platform policies.
  • Similar prompts from different users may produce similar outputs. Generated content is not guaranteed to be exclusive.

8. Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your data. By using the Service, you consent to our data practices as described in the Privacy Policy.

9. Service Availability

We strive to keep the Service available at all times but do not guarantee uninterrupted access. We may temporarily suspend the Service for maintenance, updates, or circumstances beyond our control. We will make reasonable efforts to provide advance notice of planned downtime.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, VIKTORIA MUSE AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify and hold harmless VIKTORIA MUSE from any claims, losses, damages, liabilities, and expenses (including reasonable legal fees) arising out of your use of the Service, your violation of these Terms, or your publication of content generated through the Service.

12. Termination

  • By you — you may close your account at any time through your account settings or by contacting support.
  • By us — we may suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or if required by law. We will provide notice where reasonably possible.
  • Effect of termination — upon termination, your right to use the Service ceases immediately. We will retain your data for 30 days to allow recovery, after which it will be permanently deleted in accordance with our Privacy Policy.

13. Governing Law

These Terms shall be governed by and construed in accordance with applicable law. Any disputes arising from these Terms or the Service shall be resolved through good-faith negotiation first, followed by binding arbitration or the courts of competent jurisdiction.

14. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the "Effective date" above. Continued use of the Service after changes constitutes acceptance of the revised Terms.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
